At ADIMRA we had been raising the need to allow access to foreign currency for the acquisition of capital goods not manufactured in the country. Based on communication “A”7408, the BCRA established that as of 12/1/21, exception 10.11.7 will come into force again, which allows goods whose NCM are considered goods to be paid abroad with access to the MLC. of capital without the need for prior authorization, both to clients who are direct users of the goods and to their resellers.
From this regulation, payments without registration of customs entry of BK goods by the codes B12, B20 and B21 may be transferred with access to the MLC upon presentation of a Affidavit< /strong> saying thate the amount pending regularization/application of the corresponding dispatch to place does not exceed the equivalent of USD 1,000,000 considering the amount of the payment you want to make plus the payments made under exception 10.11.7 a starting 12/1/2021.
BK payments exceeding USD 1,000,000 may also be made as long as the following conditions are verified:
The sum of the total advance payments (already regularized or not regularized) made within the framework of point 10.11.7 does not exceed 30% of the total amount of the goods to be imported.
The sum of advance, demand and commercial debt payments without customs entry registration made within the framework of this point, does not exceed 80% of the total amount of taxable assetsrtar.
